DePuy has waived its “walk-away rights” in a hip replacement settlement and will pay more than $2.5 billion to thousands of patients who were injured by DePuy ASR hip replacements. The decision to waive the rights means the company acknowledged that enough patients have agreed to the settlement.

Johnson & Johnson to settle 8,000 DePuy hip replacement lawsuits

Johnson & Johnson announced that it would settle roughly 8,000 DePuy ASR hip replacement lawsuits filed against the company. Lawyers estimated the settlement could exceed $2.5 billion, or about $250,000 per patient.

Johnson & Johnson may pay as much as $3 billion to patients who received a faulty DePuy ASR hip replacement. The money would pay an average of $300,000 to the more than 11,500 patients who suffered severe complications from the metal-on-metal hip replacement devices.

Judge rules patients can add Pinnacle device to DePuy hip complaints

A judge ruled that patients who filed DePuy ASR hip replacement lawsuits against Johnson & Johnson can also file claims about the company’s Pinnacle acetabular cup device.  Johnson & Johnson is facing more than 10,000 DePuy lawsuits involving its metal-on-metal hip replacement.

First DePuy lawsuit to go to trial in federal court in September

The first DePuy hip replacement lawsuit will go to federal court in September and may influence thousands of other DePuy ASR lawsuits. The plaintiff is New York woman Ann McCracken, who received a DePuy ASR hip replacement in 2009, and had to have it removed about 18 months later due to severe side effects.

Johnson & Johnson appeal rejected, ordered to pay $8.3 M in metal hip lawsuit

Johnson & Johnson’s appeal on an earlier jury decision has been rejected, and the company has been ordered to pay the $8.3 million verdict issued in the DePuy hip replacement lawsuit it faced in March. Other companies facing hip lawsuits include BioMet for its M2a Magnum hip replacement.
