DePuy has waived its “walk-away rights” in a hip replacement settlement and will pay more than $2.5 billion to thousands of patients who were injured by DePuy ASR hip replacements. The decision to waive the rights means the company acknowledged that enough patients have agreed to the settlement.

Johnson & Johnson to settle 8,000 DePuy hip replacement lawsuits

Johnson & Johnson announced that it would settle roughly 8,000 DePuy ASR hip replacement lawsuits filed against the company. Lawyers estimated the settlement could exceed $2.5 billion, or about $250,000 per patient.

Rochester woman to be in bellwether DePuy hip replacement trial

Ann McCracken’s DePuy lawsuit against Johnson & Johnson has been selected as one of two bellwether cases that may determine additional hip replacement lawsuits against the company. More than 7,000 patients have filed DePuy hip implant lawsuits against parent company Johnson & Johnson, alleging that the devices failed and led to injury.

Johnson & Johnson knee implant settlement approved by Australian judge

Johnson & Johnson (JNJ)’s settlement with Australian patients who received faulty knee implants was approved by a judge, clearing the way for compensation to be paid beginning at A$30,000 ($31,000) per user. In the U.S., Johnson & Johnson agreed in August to pay about $600,000 to resolve three cases in the first settlements of litigation over DePuy hip replacements.

Johnson & Johnson pays $600 K to settle first hip implant lawsuits

Johnson & Johnson agreed to pay approximately $600,000 to settle the first three hip replacement lawsuits brought against the company, according to people familiar with the settlement. The company is facing more than 8,000 lawsuits alleging that its DePuy ASR hip replacement system failed at higher than expected rates, causing severe injuries.

Internal email suggests DePuy knew about hip replacement problems before recall

An internal email from 2009 has revealed that executives at Johnson & Johnson discussed the risk of complications associated with the DePuy ASR hip replacement at least one year before the device was recalled. DePuy had previously insisted the ASR was safe and the company’s 2010 recall of the implant was strictly a business decision.

Manufacturers may eventually pay as much as $5 billion to settle lawsuits concerning their metal-on-metal hip implants according to a recent Forbes estimate. Thousands of patients have filed lawsuits alleging that they experienced complications from devices such as the DePuy ASR hip replacement.
